Who owns the copyright in “letters”?
The copyright in letters belongs to the writer of the letter. Section 178.6 Intellectual Property Code of the Philippines confirms this, referencing Article 723 of the Civil Code. While the recipient may own the physical paper, they do not own the right to publish its contents. This preserves the privacy and creative rights of the correspondent. “178.6. In respect of letters, the copyright shall belong to the writer subject to the provisions of Article 723 of the Civil Code. (Sec. 6, P.D. No. 49a)” January 7, 2026About Nicolas and De Vega Law Offices
