Who holds the power to define the jurisdiction of courts, and what is its limitation?
The Congress is granted the constitutional power to define, prescribe, and apportion the jurisdiction of various courts throughout the country. However, this legislative power is subject to a significant limitation regarding the highest court of the land. Specifically, Congress may not deprive the Supreme Court of its jurisdiction over cases enumerated in Section 5 of the same article. This separation of powers principle is detailed in Article VIII Section 2 1987 Philippine Constitution. “SECTION 2. The Congress shall have the power to define, prescribe, and apportion the jurisdiction of various courts but may not deprive the Supreme Court of its jurisdiction over cases enumerated in Section 5 hereof.” 06-Mar-26About Nicolas and De Vega Law Offices
