When is a run-off election conducted?

A run-off election is absolutely necessary when multiple unions divide the vote, and no clear winner instantly emerges. It happens when an election provides for three or more choices and results in no choice receiving a majority of the valid votes cast. The run-off is then exclusively conducted between the labor unions receiving the two highest numbers of valid votes. This procedure, dictated by Article 268 Labor Code of the Philippines, requires total votes for contending unions to be at least fifty percent. “When an election which provides for three or more choices results in no choice receiving a majority of the valid votes cast, a run-off election shall be conducted between the labor unions receiving the two highest number of votes: Provided, That the total number of votes for all contending unions is at least fifty percent (50%) of the number of votes cast.” 01-Jun-26
