What constitutes a valid certification election?

A certification election is only legally binding if enough workers actually participate in the voting process. To have a valid and recognized election, there is a strict quorum requirement that must be completely met. At least a majority of all eligible voters within the appropriate bargaining unit must have formally cast their votes. This democratic safeguard is found in Article 268 Labor Code of the Philippines to ensure representative outcomes. “To have a valid election, at least a majority of all eligible voters in the unit must have cast their votes.” 01-Jun-26
