When can the death penalty be imposed?

The death penalty shall not be imposed unless there are compelling reasons involving heinous crimes. In such instances, the Congress must specifically provide for the imposition of this penalty by law. Any death penalty that was already imposed at the time of the Constitution’s adoption was reduced to reclusion perpetua. As stated in Article III Section 19 1987 Philippine Constitution, the death penalty is generally restricted.   “Neither shall death penalty be imposed, unless, for compelling reasons involving heinous crimes, the Congress hereafter provides for it. Any death penalty already imposed shall be reduced to reclusion perpetua.”   28-Jan-26
