When can a trial proceed in the absence of the accused?

A trial may proceed notwithstanding the absence of the accused under specific conditions. This can only happen after the accused has been duly arraigned in court. The accused must have been notified of the trial and his failure to appear must be found unjustifiable. Based on Article III Section 14 1987 Philippine Constitution, this prevents the accused from indefinitely delaying the legal process.   “However, after arraignment, trial may proceed notwithstanding the absence of the accused provided that he has been duly notified and his failure to appear is unjustifiable.”   28-Jan-26
