What specific document must a previously married applicant furnish to obtain a marriage license?

A previously married individual absolutely must thoroughly prove that their former prior marriage is strictly no longer legally binding. In case either party has been legitimately previously married, the applicant shall definitely be required to specifically furnish the death certificate of the deceased spouse. Alternatively, they absolutely must explicitly provide the judicial decree of the absolute divorce, or the judicial decree of final annulment. This strict documentary evidentiary requirement is explicitly stated in Article 14 Family Code of the Philippines. “Art. 14. In case either of the contracting parties has been previously married, the applicant shall be required to furnish, instead of the birth or baptismal certificate required in the last preceding article, the death certificate of the deceased spouse or the judicial decree of the absolute divorce, or the judicial decree of annulment or declaration of nullity of his or her previous marriage.” 31-Jul-26
