What alternative document can be used if an applicant’s birth or baptismal certificate is lost?
The law generously provides highly practical alternatives if an applicant completely cannot produce their standard birth or baptismal certificate. If unable to produce the required legal certificates specifically due to complete destruction or loss, they may simply furnish their current residence certificate. They may entirely alternatively submit an instrument perfectly drawn up and sworn to containing the sworn declaration of two valid witnesses. This highly specific procedural alternative is perfectly detailed in Article 13 Family Code of the Philippines. “Art. 13. If either of the contracting parties is unable to produce his birth or baptismal certificate or a certified copy of either because of the destruction or loss of the original… such party may furnish in lieu thereof his current residence certificate or an instrument drawn up and sworn to before the local civil registrar concerned…” 31-Jul-26About Nicolas and De Vega Law Offices
