What specific act regarding the appearance of goods is deemed unfair competition?

  Selling goods that mimic the general appearance, wrapping, or verbal devices of another manufacturer’s products constitutes unfair competition. This is especially true if the appearance is likely to influence a purchaser to believe the goods are from the original dealer. Section 168.3 Intellectual Property Code of the Philippines explicitly includes the clothing of goods in such an appearance to deceive the public as a prohibited act. This rule prevents “copycat” packaging that tricks consumers into buying the wrong product,. “168.3… (a) Any person, who is selling his goods and gives them the general appearance of goods of another manufacturer or dealer… which would be likely to influence purchasers”   January 7, 2026
