What rights are conferred when the patent subject matter is a process?
The patent owner can prevent unauthorized parties from using the patented process. They are also authorized to prohibit the manufacturing or selling of products obtained directly from that process. This protection extends to the importation of items derived from the specific process. These powers are granted by Section 71 Intellectual Property Code of the Philippines. “71.1. (b) Where the subject matter of a patent is a process, to restrain, prevent or prohibit any unauthorized person or entity from using the process, and from manufacturing, dealing in, using, selling or offering for sale, or importing any product obtained directly or indirectly from such process.” January 3, 2026About Nicolas and De Vega Law Offices
