What power does a court have over infringing goods and materials?

  In an infringement action, the court can order that goods found to be infringing be disposed of outside the channels of commerce. This disposal must be done without compensation to the infringer and in a manner that avoids harm to the right holder. Section 157.1 Intellectual Property Code of the Philippines also empowers the court to order the total destruction of labels, signs, and advertising materials bearing the infringing mark. These measures are designed to permanently remove infringing items from the economy. “157.1. In any action arising under this Act… the court may order that goods found to be infringing be, without compensation of any sort, disposed of outside the channels of commerce… or destroyed”   January 7, 2026
