Under what conditions can a court double the damages awarded for infringement?

  A court has the discretion to double the damages awarded in an infringement case if specific criteria are met. This occurs when the complainant successfully demonstrates that the infringer had an actual intent to mislead the public or defraud the owner. Section 156.3 Intellectual Property Code of the Philippines provides this punitive measure to deter malicious actors. It emphasizes the legal system’s focus on punishing intentional deception in the marketplace. “156.3. In cases where actual intent to mislead the public or to defraud the complainant is shown, in the discretion of the court, the damages may be doubled.”   January 7, 2026
