What penalty is imposed if a victim of serious physical injuries loses the use of a major body part or is permanently incapacitated for their usual work?

If the consequence of the physical injuries is the loss of the use of speech, the power to hear, or the power to smell, the penalty is prision correccional in its medium and maximum periods (Article 263, Revised Penal Code). This penalty also applies if the person injured loses an eye, a hand, a foot, an arm, or a leg, or permanently loses the use of any such member. Furthermore, this classification covers injuries that result in the person becoming incapacitated for the work in which they were habitually engaged.
