The final judgment in cases of void marriages must explicitly provide for the custody and support of common children. It must also address the proper delivery of their presumptive legitimes to secure their financial future. This rule applies unless these specific matters were already adjudicated in previous judicial proceedings. The legal basis for this requirement is Article 50 Family Code of the Philippines. “Art. 50. The effects provided for in paragraphs (2), (3), (4) and (5) of Article 43 and in Article 44 shall also apply in proper cases to marriages which are declared void ab initio or annulled by final judgment under Articles 36 and 45.
