What happens to the properties of spouses when their marriage is annulled?
The properties of the spouses must undergo proper legal liquidation and distribution upon annulment. The final judgment of the court will explicitly provide for the partition of these conjugal properties. This ensures that both parties receive their rightful financial share according to the law. This procedure is legally mandated by Article 50 Family Code of the Philippines. “Art. 50. The effects provided for in paragraphs (2), (3), (4) and (5) of Article 43 and in Article 44 shall also apply in proper cases to marriages which are declared void ab initio or annulled by final judgment under Articles 36 and 45.
