What is the right to data portability?
The progressive right to data portability applies when personal information is processed by electronic means and securely stored in a structured and commonly used format. It directly grants the data subject the unconditional right to easily obtain a copy of the data undergoing processing from the personal information controller. This provided copy must be rendered in an electronic or structured format that readily allows the data subject to further utilize it for their own purposes. This modern and digital-centric right for data owners is enshrined in Section 18 Data Privacy Act. “SEC. 18. Right to Data Portability. – The data subject shall have the right, where personal information is processed by electronic means and in a structured and commonly used format, to obtain from the personal information controller a copy of data undergoing processing in an electronic or structured format, which is commonly used and allows for further use by the data subject.” 21-May-26About Nicolas and De Vega Law Offices
