What is the highest penalty for Exploitation of minors concerning the delivery of a child to a beggar, if the delivery was made for compensation?
If an ascendant, guardian, teacher, or custodian of a child under sixteen years of age delivers that child to any habitual vagrant or beggar, and the delivery is made in consideration of any price, compensation, or promise, the penalty is imposed in its maximum period (Article 278, Revised Penal Code). The baseline penalty of prision correccional in its minimum and medium periods is therefore maximized. In this case, the guardian or curator convicted must also be removed from office.
