What is the grace period for paying the renewal fee of an industrial design registration?
If an owner fails to pay the renewal fee within the twelve months preceding the registration’s expiration, a grace period is provided. Section 118 Intellectual Property Code of the Philippines grants a grace period of six months after the expiration date. To utilize this grace period, the owner must pay the renewal fee along with a prescribed surcharge. This provision helps prevent the accidental loss of rights due to late payments. “118.3. The renewal fee shall be paid within twelve (12) months preceding the expiration of the period of registration. However, a grace period of six (6) months shall be granted for payment of the fees after such expiration, upon payment of a surcharge.” January 3, 2026About Nicolas and De Vega Law Offices
