Can an industrial design registration be partially cancelled?
Yes, where the grounds for cancellation relate to only a part of the industrial design, cancellation can be limited to that extent. This possibility is mentioned in Section 120 Intellectual Property Code of the Philippines. The restriction can take the form of an alteration of the affected features of the design. This allows the owner to maintain protection for the remaining valid portions of their design. “120.2. Where the grounds for cancellation relate to a part of the industrial design, cancellation may be effected to such extent only. The restriction may be effected in the form of an alteration of the effected features of the design.” January 3, 2026About Nicolas and De Vega Law Offices
