What is the general rule regarding the transfer of private lands?

The Constitution enforces strict regulations on who can acquire private lands within the country. As a general rule, no private lands shall be transferred or conveyed to unqualified individuals or entities. Such lands can only be transferred to individuals, corporations, or associations that are qualified to acquire or hold lands of the public domain. The only recognized exception to this strict prohibition is in cases of hereditary succession, as stated in Article XII, Section 7, 1987 Philippine Constitution. “Save in cases of hereditary succession, no private lands shall be transferred or conveyed except to individuals, corporations, or associations qualified to acquire or hold lands of the public domain.” 22-Mar-26
