What is the effect of cancellation of a patent or specific claims on the rights of the patentee?

  Cancellation terminates the rights conferred by the cancelled patent or claims. Section 66, Intellectual Property Code of the Philippines, states that the rights conferred by the patent or any specified cancelled claim or claims shall terminate, and notice of the cancellation shall be published in the IPO Gazette. It further provides that, unless restrained by the Director General, the decision or order to cancel is immediately executory even pending appeal. This ensures that invalid patents or claims no longer encumber the public or competitors once cancellation is ordered.   21-Dec-25
