What is the effect if both spouses act in bad faith in a subsequent marriage?

When both spouses intentionally enter into a subsequent marriage in bad faith, the legal consequences are exceptionally severe. The law treats the entire marital contract with absolute disdain, rendering it completely void ab initio. This uncompromising stance is found in Article 44 Family Code of the Philippines. Furthermore, all donations and testamentary dispositions made between them by reason of the marriage are automatically revoked. “Art. 44. If both spouses of the subsequent marriage acted in bad faith, said marriage shall be void ab initio and all donations by reason of marriage and testamentary dispositions made by one in favor of the other are revoked by operation of law.” 31-Jul-26
