What is the effect if both spouses act in bad faith in a subsequent marriage?
When both spouses intentionally enter into a subsequent marriage in bad faith, the legal consequences are exceptionally severe. The law treats the entire marital contract with absolute disdain, rendering it completely void ab initio. This uncompromising stance is found in Article 44 Family Code of the Philippines. Furthermore, all donations and testamentary dispositions made between them by reason of the marriage are automatically revoked. “Art. 44.
