Can an innocent spouse revoke an irrevocable insurance beneficiary designation?

Normally, a beneficiary designation in an insurance policy stipulated as strictly irrevocable cannot be unilaterally changed. However, the termination of a subsequent marriage due to bad faith introduces a very unique legal exception. Under Article 43 Family Code of the Philippines, the innocent spouse is granted the power to revoke such a designation. This ensures that the guilty spouse does not unjustly benefit from the innocent party’s insurance policy. “4. The innocent spouse may revoke the designation of the other spouse who acted in bad faith as a beneficiary in any insurance policy, even if such designation be stipulated as irrevocable;” 31-Jul-26
