What is the crime and penalty for a simple discharge of a firearm at another person?
A person who shoots at another with any firearm shall suffer the penalty of prision correccional in its minimum and medium periods (Article 254, Revised Penal Code). This penalty applies unless the facts of the case dictate that the act constitutes a more serious offense. If the circumstances show intent to kill, the act may be classified as frustrated or attempted parricide, murder, or homicide, which prescribe a higher penalty under other articles of the Code.
