What is the consequence of an irregularity in the formal requisites of marriage?

Not all issues with the formal requisites will completely invalidate the marital union. An irregularity in the formal requisites shall absolutely not affect the validity of the marriage itself. However, the party or parties specifically responsible for the irregularity shall be held civilly, criminally, and administratively liable. This crucial principle ensuring the validity of the marriage despite such irregularities is established in Article 4 Family Code of the Philippines. “Art. 4. […] An irregularity in the formal requisites shall not affect the validity of the marriage but the party or parties responsible for the irregularity shall be civilly, criminally and administratively liable.” 31-Jul-26
