What is required before private property is taken for public use?

The state has the power of eminent domain but it must follow specific constitutional guidelines. Private property cannot be taken for public use unless the owner receives just compensation. This ensures that property rights are respected even when the public interest is being served. Based on Article III Section 9 1987 Philippine Constitution, this is a vital protection against the arbitrary taking of property.   “SECTION 9. Private property shall not be taken for public use without just compensation.”   28-Jan-26
