What is “public lending” under the Code?

  Public lending is the transfer of possession of a work or sound recording for a limited duration. As defined in Section 171.5 Intellectual Property Code of the Philippines, this activity must be for non-profit purposes. It is typically performed by institutions like public libraries or archives whose services are open to the general public. This allows for the dissemination of knowledge without infringing on the commercial rental rights.   “171.5. ‘Public lending’ is the transfer of possession of the original or a copy of a work or sound recording for a limited period, for non-profit purposes, by an institution the services of which are available to the public, such as public library or archive;”   January 7, 2026
