What happens to evidence obtained through an illegal search?

Any evidence that is obtained in violation of the right against unreasonable searches is inadmissible. This means it cannot be used for any purpose in any legal proceeding against an individual. This rule acts as a deterrent against law enforcement performing illegal acts to gather proof. Based on Article III Section 3 1987 Philippine Constitution, such evidence is legally “poisoned”.   “(2) Any evidence obtained in violation of this or the preceding section shall be inadmissible for any purpose in any proceeding.”   28-Jan-26
