What happens if a female employee undergoes gynecological surgery while on maternity leave?

If a female employee undergoes gynecological surgery during her maternity leave, she is entitled to receive the difference between the maternity leave benefits and the special leave benefit. Whenever the maternity leave and special leave benefits overlap, the employee will only receive full pay for each day covered by both benefits. This is because both benefits are legally considered paid leave under Republic Act No. 9710 and related labor laws.
