The crime committed is Disobeying request for disqualification, which occurs when a public officer has been lawfully required to refrain from continuing a proceeding (Article 242, Revised Penal Code). Despite this lawful requirement, the officer continues the proceeding before the question of jurisdiction has been formally decided. This act demonstrates a defiance of proper legal procedure and judicial restraint. The officer shall be punished by arresto mayor and a fine not exceeding One hundred thousand pesos only (P100,000).
