What are the conditions and penalty for an officer of the executive branch who commits Usurpation of judicial functions?
An officer belonging to the executive branch of the Government commits Usurpation of judicial functions if they assume judicial powers themselves (Article 241, Revised Penal Code). The officer is also guilty if they obstruct the execution of any order or decision that has been rendered by a judge acting within the limits of their jurisdiction. The applicable penalty for this crime is arresto mayor in its medium period to prision correccional in its minimum period. This penalizes executive interference in the judicial process.
