What acts constitute patent infringement?

  Infringement occurs when someone makes, uses, or sells a patented product without the owner’s authorization. Using a patented process without permission or importing products from such a process also constitutes infringement. However, certain limitations like government use and experimental use are exempted. This definition of infringement is provided in Section 76 Intellectual Property Code of the Philippines.   “76.1. The making, using, offering for sale, selling, or importing a patented product or a product obtained directly or indirectly from a patented process, or the use of a patented process without the authorization of the patentee constitutes patent infringement.”   January 3, 2026
