Under what exact condition can an employer hire apprentices without any compensation?

The general labor rule requires compensation for all work, but specific educational scenarios allow for unpaid apprenticeships under strict supervision. The Secretary of Labor and Employment holds the exclusive authority to authorize the hiring of apprentices without any compensation. This is permitted only when the on-the-job training is expressly required by the school or formal training program curriculum. It is also allowed if the training serves as an absolute requisite for graduation or board examination, as established in Article 72 Labor Code of the Philippines. “ART. 72. Apprentices Without Compensation. – The Secretary of Labor and Employment may authorize the hiring of apprentices without compensation whose training on the job is required by the school or training program curriculum or as requisite for graduation or board examination.” 31-May-26
