Under what conditions will the IPO grant a patent, and when does the patent take effect?
A patent is granted if the application meets all the requirements of the Intellectual Property Code and all fees are paid on time. Section 50.1, Intellectual Property Code of the Philippines, directs the Office to grant the patent when these conditions are satisfied. Section 50.2 states that if grant and printing fees are not paid on time, the application is deemed withdrawn. Section 50.3 clarifies that the patent takes effect on the date of publication of the grant in the IPO Gazette.
