Can an applicant appeal a final refusal of a patent application by the examiner?

  Yes, a final refusal by the examiner is appealable. Section 51.1, Intellectual Property Code of the Philippines, states that the final order of refusal of the examiner to grant the patent shall be appealable to the Director in accordance with the Act. Section 51.2 adds that the Regulations will provide the procedure for appealing from the Director’s order of refusal. This gives applicants a hierarchical remedy within the IPO structure to contest adverse decisions.   21-Dec-25
