Under Article 251, if a death occurs during a tumultuous affray, and the person who inflicted the fatal blow cannot be identified, who is held liable?
The law first seeks to identify the person or persons who inflicted serious physical injuries upon the deceased during the affray (Article 251, Revised Penal Code). If such persons can be identified, they shall be punished by the penalty of prision mayor. The affray itself is characterized as several unorganized persons quarreling and assaulting each other in a confused and tumultuous manner.
