On what grounds can the registration of a collective mark be cancelled?

  A collective mark registration can be cancelled if it is proven that only the registered owner, rather than the intended group, uses the mark. Cancellation also applies if the mark is used in a manner that deceives the public regarding the origin or characteristics of the goods. Section 167.3 Intellectual Property Code of the Philippines includes contravention of the mark’s governing agreement as an additional ground for cancellation. These rules ensure that collective marks are used for their intended purpose of identifying group affiliation,. “167.3. In addition to the grounds provided in Section 149, the Court shall cancel the registration of a collective mark if… only the registered owner uses the mark”   January 7, 2026
