Must a manager possess hiring and firing authority to be exempted from holiday pay?

In accordance with the exemptions for Article 94 of the Labor Code of the Philippines, true managerial employees must possess the distinct legal authority to hire or fire. Alternatively, their professional suggestions and recommendations regarding hiring, firing, promotion, or status changes must be given particular weight by the company. This decisive administrative power serves as the final qualifying condition to correctly classify an employee as managerial for legal exemption purposes. Without possessing such authority, the employee cannot be fully exempted from receiving mandatory holiday pay. 15-May-26
