Is the commission of a crime against an employer’s immediate family member considered a valid ground for termination?
Committing a crime or offense is a serious infraction that can severely impact the employer-employee relationship. Under the law, an employer can legally terminate an employee who commits a crime against the person of the employer. Furthermore, this protection extends to the employer’s family, allowing termination if the crime is committed against any immediate member of the employer’s family. It also applies if the offense is directed at the employer’s duly authorized representatives. This just cause for dismissal is expressly provided in Article 297 Labor Code of the Philippines. “(d) Commission of a crime or offense by the employee against the person of his employer or any immediate member of his family or his duly authorized representatives;” 02-Jun-26About Nicolas and De Vega Law Offices
