Does the law allow an employer to dismiss an employee who willfully breaches the trust of the employer’s duly authorized representative?
The law recognizes that the relationship between an employer and an employee is inherently built on trust and confidence. Therefore, an employer is fully permitted to terminate an employee who commits fraud or a willful breach of this trust. Notably, this applies not only when the trust is reposed by the employer directly, but also when it is reposed by the employer’s duly authorized representative. Such betrayal of trust destroys the working relationship and serves as a just cause for immediate dismissal. This specific ground for termination is outlined in Article 297 Labor Code of the Philippines. “ART. 297. Termination by Employer. – An employer may terminate an employment for any of the following causes: … (c) Fraud or willful breach by the employee of the trust reposed in him by his employer or duly authorized representative;” 02-Jun-26About Nicolas and De Vega Law Offices
