Is giving financial support to a labor organization by an employer considered a ULP?
While financial support might seem beneficial, it utterly undermines the independence of a labor union. It is unlawful for an employer to initiate, dominate, assist, or interfere with the formation or administration of any labor organization. This explicitly includes providing financial or other support to the union, its organizers, or active supporters. Such company-domination tactics are classified as unfair labor practices under Article 259 Labor Code of the Philippines. “(d) To initiate, dominate, assist or otherwise interfere with the formation or administration of any labor organization, including the giving of financial or other support to it or its organizers or supporters;” 01-Jun-26About Nicolas and De Vega Law Offices
