Can an employer discriminate in wages to discourage union membership?
Any form of discrimination meant to manipulate union membership is strictly forbidden under the law. Employers are prohibited from discriminating in regard to wages, hours of work, and other conditions of employment. This rule applies whether the intent is to encourage or heavily discourage membership in any labor organization. This discriminatory practice is explicitly penalized as an unfair labor practice under Article 259 Labor Code of the Philippines. “(e) To discriminate in regard to wages, hours of work and other terms and conditions of employment in order to encourage or discourage membership in any labor organization.” 01-Jun-26About Nicolas and De Vega Law Offices
