Is a marriage license legally required if either or both parties are at the point of death?
The law gracefully provides a crucial exemption from the strict marriage license requirement in highly life-threatening situations. In case either or both of the contracting parties are at the absolute point of death, the marriage may proceed. The marriage may be properly solemnized without the absolute necessity of a marriage license. This marriage shall remain entirely valid even if the ailing party survives, governed by Article 27 Family Code of the Philippines. “Art. 27. In case either or both of the contracting parties are at the point of death, the marriage may be solemnized without the necessity of a marriage license and shall remain valid even if the ailing party subsequently survives.” 31-Jul-26About Nicolas and De Vega Law Offices
