How much time was given to file money claims that had already accrued prior to the effectivity of the Labor Code?
When the Labor Code was enacted, it introduced new prescriptive periods for filing various claims. For money claims that had already accrued prior to the law’s effectivity, a transitional grace period was provided. Affected individuals were required to file these older claims with the appropriate entities within exactly one year from the date of the Code’s effectivity. If they failed to file within this specific one-year window, the claims were forever barred. This transitional prescriptive period is detailed in Article 306 Labor Code of the Philippines. “All money claims accruing prior to the effectivity of this Code shall be filed with the appropriate entities established under this Code within one (1) year from the date of effectivity, and shall be processed or determined in accordance with the implementing rules and regulations of the Code; otherwise, they shall be forever barred.” 02-Jun-26About Nicolas and De Vega Law Offices
