How is the thirteenth-month pay calculated for a resigned employee who worked from January to September?
If a resigned employee worked only from January to September, their thirteenth-month pay is calculated proportionately. The computation is reckoned from the time they started working up to the time of resignation. Under Presidential Decree No. 851, their proportionate pay should be exactly equal to one-twelfth of their total basic salary earned during those nine months. This ensures they receive a fair, prorated amount of the annual benefit. 17-May-26About Nicolas and De Vega Law Offices
