How is the penalty mitigated if the person inducing the minor to abandon home is the minor’s father or mother?
If the person committing the crime of kidnapping a minor or inducing them to abandon home is the minor’s own father or mother, the penalty is significantly mitigated (Article 271, Revised Penal Code). In this specific familial case, the penalty shall be arresto mayor or a fine not exceeding Forty thousand pesos (P40,000), or both. This mitigation acknowledges the parental relationship, even when custody is violated.
