How is the penalty for Qualified trespass to dwelling modified if the offense is committed by means of violence or intimidation?
If the offense of Qualified trespass to dwelling is committed by means of violence or intimidation, the penalty is significantly increased (Article 280, Revised Penal Code). In this aggravated scenario, the perpetrator shall be punished by prision correccional in its medium and maximum periods. Furthermore, a fine not exceeding Two hundred thousand pesos (P200,000) shall also be imposed.
