How is the penalty for Abandoning a minor affected if the child’s life is endangered or if death results from the abandonment?
If the abandonment results in the death of the minor, the culprit shall be punished by prision correccional in its medium and maximum periods (Article 276, Revised Penal Code). If the life of the minor was merely put in danger, the penalty is prision correccional in its minimum and medium periods. These penalties are imposed without prejudice to any punishment for a more serious offense that may have been committed.
