How is the crime of Homicide defined and what is its prescribed penalty?
Homicide is defined as the killing of another person, provided the perpetrator does not fall within the provisions of Parricide (Article 246) (Article 249, Revised Penal Code). Importantly, Homicide must be committed without the attendance of any of the qualifying circumstances enumerated for Murder (Article 248). Any person deemed guilty of Homicide shall be punished by the penalty of reclusion temporal. This offense serves as the default crime against life when qualifying or privileged circumstances are absent.
