How does the court treat an affidavit submitted by a copyright owner?

  The court is required to admit the affidavit as evidence and assume it was made by or on behalf of the owner. The matters stated in the affidavit are considered prima facie proof until the contrary is proved. This simplifies the presentation of evidence regarding ownership and subsistence. This rule is set by Section 218.1 Intellectual Property Code of the Philippines.   “The affidavit shall be admitted in evidence… and shall be prima facie proof of the matters therein stated until the contrary is proved, and the court… shall assume that the affidavit was made by or on behalf of the owner…”   January 8, 2026
